Stephen Robertson, University of Sydney, Australia Introduction In western law, the age of consent is the age at which an individual is treated as capable of consenting to sexual activity. Consequently, any one who has sex with an underage individual, regardless of the circumstances, is guilty of a crime. Narrowly concerned with sexual violence, and with girls, originally, since the 19th century the age of consent has occupied a central place in debates over the nature of childhood, adolescence, and adulthood, and been drawn into campaigns against prostitution and child marriage, struggles to achieve gender and sexual equality, and the response to teenage pregnancy. This module traces the shifting ways that the law has been defined, debated and deployed worldwide and from the Middle Ages to the present. An age of consent statute first appeared in secular law in in England as part of the rape law. The statute, Westminster 1, made it a misdemeanor to “ravish” a “maiden within age,” whether with or without her consent. The phrase “within age” was interpreted by jurist Sir Edward Coke as meaning the age of marriage, which at the time was 12 years of age. A law making it a felony to “unlawfully and carnally know and abuse any woman child under the age of 10 years” was generally interpreted as creating more severe punishments when girls were under 10 years old while retaining the lesser punishment for acts with and year-old girls.

IF you do not feel it is safe to divulge your situation by yourself, find an adult that your parents trust to help you tell them.

The law only recognizes as legal the acts of persons who possess the capacity to form the proper intent to perform the particular acts. Two aspects of “capacity” are recognized: It is maintained that when a child reaches a certain age his or her capacity to form the proper intent matures. Considering the Evidence in its Entirety The Federal Court has made it clear in a number of cases that when assessing the credibility of a claimant, it is important to remember that all of the evidence, both oral and documentary, must be considered and assessed, not just selected portions of the evidence. Note 35 Thus the RPD should not selectively refer to evidence that supports its conclusions without also referring to evidence to the contrary. Note 36 Furthermore, when assessing all of the evidence, it must be assessed together, not parts of it in isolation from the rest of the evidence.
Evidence should, therefore, be treated in a consistent manner. Note 37 The Federal Court has also emphasized that it is important not just to concentrate on exaggerations, Note 38 but neither should a decision-maker disregard aspects of the evidence that are not favourable to the claimant. Note 39 Thus the panel must do more than simply search through the evidence looking for inconsistencies or for evidence that lacks credibility, thereby “building a case” against the claimant, and ignore the other aspects of the claim.
The Board is presumed to have taken all of the evidence into consideration whether or not it indicates having done so in its reasons, unless the contrary is shown.

However, I think many executors out there would appreciate having an overview of their duties, either as a first-time checklist, or as a refresher of what they learned when they first began working on the estate. So here is a list of what an executor in Canada is supposed to do note that an administrator appointed by the court has to do these things as well, though he or she cannot do them until they are appointed: Give all assets and liabilities a value as of the date of death.
